INVITED PRIVATE BETA • VERSION RIGWAVE-PRIVATE-BETA-TERMS-V1-2026-10-01
Private Beta Terms & EULA
These terms govern the no-payment, invitation-only RigWave Windows private beta. They are separate from the later public trial and paid-customer terms.
1. Who you are contracting with
RigWave Streaming Systems is the trading name of Gary Woodward, sole trader, of 6 Adlington Drive, Northwich, Cheshire, CW9 8BP, United Kingdom. Legal and privacy enquiries: info@rigwavesystems.co.uk.
2. Eligibility and invitation
You must be at least 18 and personally invited. The invitation, tester code and beta access are for you only. They are not transferable and may be revoked if the beta is withdrawn, replaced, compromised or materially misused.
3. Beta licence
Subject to these terms, RigWave grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the exact approved private-beta candidate on the authorised testing device solely to evaluate RigWave and provide private feedback. No ownership of RigWave is transferred.
4. Pre-release risk
The beta is unfinished software. Features may fail, change, be disabled or be withdrawn. Keep Windows security protections enabled, back up important settings, and do not use the beta as the sole control path for a critical broadcast or paid event until you have proved it on your setup. Nothing in these terms excludes rights or liability that UK law does not permit to be excluded.
5. Permitted and prohibited use
You may test normal product functions and report defects. You must not redistribute the installer; share your tester code or download URL; publish the build, screenshots, recordings, benchmark results or non-public product details; remove rights notices; bypass licence, candidate, security or access controls; use the beta unlawfully; or use it to attack RigWave, another person or a third-party service.
Restrictions on reverse engineering, decompilation, observation or backup apply only to the extent permitted by law. Nothing here restricts a statutory act that cannot lawfully be excluded.
6. RigWave intellectual property
RigWave software, source code, object code, brand, artwork, interface designs, documentation, tuning logic, scoring, recommendations, proprietary methods, workflows and non-public technical information remain the intellectual property or confidential information of Gary Woodward / RigWave Streaming Systems, subject to third-party and open-source rights.
7. Your content
You keep ownership of your music, recordings, screenshots, logs and other material you own. You are responsible for permissions and licences for third-party content and services used during testing.
8. Feedback licence
You keep any copyright you own in feedback you create. You grant RigWave a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, analyse and incorporate your non-confidential ideas, suggestions, defect descriptions and product feedback into RigWave products, documentation and services. This does not transfer ownership of your pre-existing material and does not override the Beta Privacy Notice for personal data.
9. Updates, withdrawal and expiry
Only the exact candidate identified by the official beta gate is authorised. RigWave may retire a candidate or invitation when a material defect or security issue is found. A retired candidate is not re-authorised merely because you still possess a copy.
10. Liability and statutory rights
Testing is provided without charge and on a pre-release basis. To the fullest extent lawfully permitted, RigWave does not promise uninterrupted or error-free operation or permanent third-party compatibility. Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability or statutory right that cannot lawfully be excluded or restricted.
11. Law
These terms are governed by the law of England and Wales, but this does not deprive you of mandatory consumer protections or court rights that apply to you under applicable law.
12. Documents forming the beta agreement
Your private-beta access is governed by these Terms/EULA, the separate Private Beta NDA/Confidentiality Undertaking, and the Beta Privacy Notice. Materially changed versions require fresh acceptance before a new gated download is disclosed.
